Can you hire a law student to help your EEOC claim?

While everyone is entitled the freedom of choice to file pro-se (represent yourself) or to seek someone without a law degree to help you with your EEOC civil rights discrimination, the legal assistance in my opinion will help you to more likely lose your EEOC civil rights discrimination claim, then to win.

Attorney’s fees

Attorney’s fees are only allowable for the services of:

  1. Members of the Bar
  2. Law clerks
  3. Paralegals 
  4. Law students under the supervision of members of the Bar.  

29 C.F.R. § 1614.501(e)(1)(iii).  Complainant cannot collect fees for the value of his own time spent processing the complaint.

Therefore, after a careful review of the record, including arguments and
evidence not specifically discussed in this decision, the Commission
modifies the agency’s final decision and orders the  agency pay
complainant compensatory damages in accordance with this decision and
the ORDER below.
