In Davis v. United States Postal Service, EEOC Appeal No. 01A33363
(December 14, 2004) (Davis II), the Commission modified FAD II, increased
the award of compensatory damages to $20,000, and ordered the agency
to pay $16,735 in attorney’s fees.2 We denied complainant’s claim for
costs because she failed to submit evidence as to her claimed expenses.
In footnote 1, we noted that complainant might be entitled to an
additional award of attorney’s fees for legal services rendered after
January 23, 2003, and we directed complainant to submit a fee petition
to the agency.
